TERMS AND CONDITIONS OF THE EOD SERVICE IN THE UNIVERSITY OF TARTU LIBRARY

§ 1 Making digital copies

Digital copies are made of books whose copyright term has expired. Books are digitized in their entirety. To receive a digital copy, or e-book, one is to fill out an order form. When the order form has been submitted, the University of Tartu Library (henceforth Library) will send a confirmation e-mail to the Customer´s e-mail address he has specified in the order form. The reception of the order form and the notification thereof is done automatically. 

Orders for digital copies are accepted from registered users of the Library and from natural and legal persons. If an order is submitted by a natural person who is not a registered user of the Library, with the submitting of the order he grants permission to the Library to enter his data into the Library´s database of users. 

The service is provided on equal terms and conditions for both legal and natural persons. 

The Library will draw up a cost estimation for the digital copy if the Customer did not receive it at once while filling out the order form, or if the Customer specifically expresses his wish to receive one. The drawing up of the cost estimation is free of charge and is not legally binding. 

After receiving the filled order form, the Library will check the validity of the rights of the author and distributor of the book. The Library will also check whether the book is available for copying and whether the physical condition of the book allows the copying. The Library has the right to decline to make the copy, if for the above or other reasons it is not possible to digitize the book; the Library will inform the Customer about it within three (3) working days. 

§ 2 Terms of use; prohibition to hand over the digital copies to third parties

The Customer will be entitled to personal use of the digital copy on any hardware belonging to him. The digital copy may be used solely personally for learning or research purposes. All other possible uses, including commercial ones, will be prescribed by a separate agreement. The Customer shall not give the digital copy to third parties or make it publicly available on the Internet, unless he has previously agreed on this in writing with the Library. 

§ 3 Delivery of the digital copy (e-book)
§ 3.1. Download of the digital copy from the Internet


The digital copy of a book is reckoned to have been delivered and the service provided since the moment when the Library has informed the Customer of the Internet address where he can download the digital copy by sending an e-mail to his e-mail address provided by him in the order form. After informing the Customer, the Internet address is active for 60 days. The Library will make the ordered digital copy available after the payment for the service has been received. The ordered digital copy cannot be returned. 

§ 3.2. Delivery of the digital copy on CD-ROM or DVD
If the Customer wants the digital copy on a medium (CD-ROM or DVD), he will receive it at the Library Information Desk, or it will be sent by registered mail to the postal address he specified in the order form. The ordered DVDs and CD-ROMs cannot be returned. 

The Library will do everything in its power to fulfil the order within ten (10) working days. The term is not binding if it has been agreed otherwise with the Customer, or the delivery of the e-book is delayed for the guilt of third parties (e.g., the postal service provider). 

Tartu Ülikooli Raamatukogu teeb kõik endast oleneva, et täita tellimus vähemalt 10 (kümne) tööpäeva jooksul. Tähtaeg ei ole siduv, kui Tellijaga on kokku lepitud teisiti või e-raamatu kättetoimetamine viibib kolmandate isikute (nt. postiteenuse osutaja) süül. 

§ 4 Paying for the digital copy

The Customer shall take the obligation to pay for the digital copy within ten (10) days of receiving the notice from the Library on the fulfilment of his order. The notice will be sent to the e-mail address specified by the Customer in the order form. 

The Customer can pay for the service as follows:

  • By credit card on the Internet
  • By bank transfer on the basis of an invoice
  • By transfer within the University of Tartu
  • In cash in the Library

§ 5 Responsibility for a deficient product

The Library will not guarantee or take any responsibility that the ordered digital copy will meet the Customer´s special wishes. It is not possible to guarantee complete optical character recognition, which depends on the language, age, font, etc. of the book being digitized. 

The Library will take no responsibility for temporary breaks in download of the digital copy that can result from a force majeure, operation system failures, or a situation that cannot be foreseen technologically.
