General Terms and Conditions

§ 1 PROVISION OF DIGITISING SERVICE

A Customer will place an application for ordering a digital copy of the book (eBook). After receiving the application, the National Library of Estonia (NLE) will send the Customer an e-mail message acknowledging receipt of his/her order by NLE and stating the particulars thereof (acknowledgment of receipt). Such acknowledgment of the receipt does not constitute acceptance of the offer by NLE but informs the Customer that his/her order has been received by NLE. The orders are received and receipts of the orders delivered automatically.
The NLE provides digitising service only to its registered users and institutions. If the party who orders is not registered as the NLE user, he/she thereby grants consent for entering his/her data into the NLE users database.

The NLE will draw up cost estimate in case the Customer has not received it automatically after placing the order. Cost estimate is not legally binding and drawing it up is free of charge.

At least within 3 (three) working days the NLE will send an e-mail on the Customer's e-mail address, which confirms whether the book is available for digitisation and whether its digitisation is possible. Such confirmation depends, among other things, on the availability of the book and on the physical condition of the book being such as to permit digitisation, and on no copyrights/exclusive rights to use the work being infringed.
The NLE holds the right to refuse the order on the above mentioned reasons or on other reasonable excuses and will inform the Customer of the refusal within 3 (three) working days.

The customer, ordering the digitisation, supports the preservation of our cultural heritage. From now on the digital copy of a book is freely accessible worldwide and the valuable origin can be safely preserved for the future.

§ 2 CONDITIONS OF USE AND BAN ON PASSING ON TO THIRD PARTIES

Unless agreed otherwise, the Customer is granted the right to use a digital copy of the book (eBook) for his/her own purposes on any hardware to be provided by the Customer. All uses in excess thereof are subject to separate written agreement. The Customer is only entitled to use the eBook for study or research purposes within the scope of these General Terms and Conditions. The Customer is not entitled to make eBooks available to third parties, whether for consideration or free of charge. Digital copy of a book is not permitted to be made available in Internet by a Customer, unless agreed otherwise.

§ 3 DELIVERY OF eBOOKS

§ 3.1. The delivery of the eBook by download
The delivery of the eBook by download takes place and the service is considered to be provided in that a link for download is provided by the NLE to the Customer on the e-mail address designated by him/her when placing the order. The NLE will ensure the availability of the link for 60 (sixty) days after sending it to the Customer. The NLE will only make the eBook available after the Customer has paid for the eBook and the NLE has received the payment. The possibility of withdrawal of the eBook that the Customer has ordered is excluded.

§ 3.2. The Delivery of the eBook on CD-ROM or DVD
If the Customer has ordered an eBook on CD-ROM or DVD, the ordered eBook will be sent to the Customer by registered mail on the postal address designated when placing the order or delivered to the Customer at the NLE on the spot. The possibility of withdrawal of the eBook that the User has ordered is excluded.

The NLE will endeavour to make delivery of the eBook to the User within 14 (fourteen) days. However, such time limit is non-binding in exceptional cases when other delivery date has been promised in a binding manner or the delivery is delayed by a third party (e.g. postal service provider) at fault.

§ 4 PAYMENT FOR THE SERVICE

The Customer undertakes to pay for the service within 10 (ten) days after the e-Book he/she has ordered is produced. The NLE will inform the Customer of the fulfillment of the order by e-mail on the e-mail address designated by him/her when placing the order.

The Customer can pay either

  • by credit card on the Internet (online payment systems)
  • by invoice
  • in cash or by debit card at the NLE on the spot.

§ 5 LIABILITY FOR DEFECTS

With respect to the eBook ordered, the NLE does not warrant or assume liability that the digital copy will conform to specific expectations of the User. Automatic text recognition (OCR) in particular cannot be fully guaranteed and depends on the individual book that is being digitised (type font, language, age of the original book).

A temporary suspension of services, e.g., of the download link or the tracing page, that arises from force majeure, from operational breakdowns or from circumstances which are not foreseeable from an engineering point of view, does not give rise to a liability of the NLE.
